A Federal High Court in Abuja has granted the Peoples’ Democratic Party an order of mandamus to compel the Speaker of Nigeria’s House of Representatives, Aminu Tambuwal, to declare his own seat vacant.

The court also gave the party the permission to serve the Speaker and Deputy Speaker as defendants through the Clerk of the House of Representatives.

The PDP is seeking to compel the Speaker to act upon the provisions of Section 68 sub section two which mandates him to declare the seat of any defected member vacant.

PDP is further seeking to obtain an order compelling the Deputy Speaker to declare the Kebbe/Tambuwal Federal constituency currently occupied by Tambuwal in the lower chamber vacant.

PDP’s counsel, Mike Ahamba says the substantive suit will be filed on Tuesday
