An Ekiti State High Court has dismissed the suit brought against the state government by a 10-year-old JSS1 Student of Mary Immaculate Secondary School in Ado ekiti.

Gift Agenoisa dragged the Ekiti State Government to court demanding N15 million compensation for physical abuse and violation of rights.

Miss Agenoisa had told the court that her school principal’s punishment for indecent hairdo amounted to breach of her rights.

The court holds that it is hearsay from the deponent that the young girl was inflicted with 20 strokes of cane, as the mother was not there at the time, and based her testimony on third party information.

Justice Lekan Ogunmoye also points out that the claim by the applicant on physical abuse, admission of the girl to the hospital for two days and inflictions of lifetime injuries, were not corroborated by the medical reports brought before the court.

On the punishment by the Principal of the school, the court points out that every organized society has its own code of conduct, hence the action of the Instructors were in order.

Paragraph 28 of the Prospectus of Mary Immaculate Secondary School, Ado Ekiti, the school where the act took place, states “Every Pupil must obey the Simple Hairstyle of the School…”
