A federal high court sitting in Yola has dismissed a suit filed by the impeached Governor of Adamawa State, Murtala Nyako, seeking his reinstatement as chief executive of the state.
Murtala Nyako had prayed the court to nullify his impeachment which took place in July last year, and return him as governor of the state
His had told the court that he was denied his right of fair hearing following failure of the state assembly to personally serve him with notice of impeachment
Before filing the suit at the Federal High Court in Yola, Mr. Nyako had earlier filed the same case at the court in Lagos and another high court sitting in Abuja with the same prayer of reinstating him as governor of Adamawa state
In her ruling, the presiding judge, Bilkisu Bello Aliyu established that the right of fair hearing of Murtala Nyako was infringed upon by the failure of the state assembly to personally serve him with the notice of impeachment but faulted Nyako for filing the same case in three different courts
Justice Aliyu therefore struck out the case for what she termed abuse of court process
