An Imo state high court sitting in Owerri on Thursday declined to order a stay of execution on its earlier judgment pronouncing Jude Okeke as the National Chairman of the All Progressive Grand Alliance.
The court also directed the Independent National Electoral Commission to recognize all correspondence from his faction for the November 6 Governorship Election in Anambra State.
An application from the Victor Oye-led APGA had urged the court to stay execution of it’s earlier judgement on the matter.
The faction also sought the leave of the court to appeal the judgement.
Giving judgement on the applications, Justice Victoria Isiguzo granted Oye leave to appeal but refused to grant the prayer on stay of execution, rather reaffirmed its earlier judgement on the matter.
Counsel to the third respondent Collins Asikilobi noted that all consequential orders made by the trial court are binding on all parties involved in the matter until the appellate court says otherwise.
